Dutch Justice annuls the seizure of 300 000 PlayStation 3

Sony will be able to repossess the 300,000 PlayStation 3 seized by Dutch customs in the wake of its legal battle with the manufacturer LG Electronics. Dutch courts had indeed ordered consoles seized since the end of February are made by Sony, which will resume distribution in the European market. LG has launched in early February of litigation against Sony for infringement of several patents for disc playback bluray player, whose PlayStation 3 is equipped.

The complaints, filed in the United States and the Netherlands sought to block the sale of the consoles on their territory. In the Netherlands, Justice had accepted the request from LG, ordering the seizure of shipments of PlayStation 3 arriving through the ports of the country to feed the European market from 28 February.

LG's lawyers have indeed managed to persuade the judges of the court of Breda to act immediately without Sony is accused, so that the manufacturer did not have time to reorganize its supply chain by moving Deliveries to other European ports. This has not affected the supply of consoles in stores, Sony have 2 to 3 weeks of inventory, but a higher duration of seizure could have caused serious shortages.

MUTUAL ACCUSATIONS OF PATENT INFRINGEMENT "The main reason for the lifting of the seizure of the consoles is that this type of measure is disproportionate when considering the legal liability and the negotiations between the two companies," writes Florian Mueller, who runs a blog on patents in the software sector, citing the lawyers present on site.

LG and Sony, in fact, accuse each other of violating patents. If LG tackles Blu-Ray, Sony says that LG has violated patents in several areas, especially for liquid crystal displays which equips its mobile phones. Any litigation between the manufacturers of electronic equipment for patent infringement are very common.

LG, Sony will pay 130,000 euros in payment of court costs, and shall ensure that the brackets are properly restored to Sony, with 200 000 euros per day late penalty. The Korean group will also make more seizures of material previously unannounced Sony. But the legal battle between the two companies is not yet complete.

LG believes that it should receive between 2.50 and 2.55 dollars in damages for all machines with BluRay player sold by Sony. Sony has passed 47 million PlayStation 3, the sum would amount to at least $ 150 million (108 million euros).
