Italian ruling against Yahoo "Just links to sites with pirated movies"

For the first time the judiciary has established the principle of responsibility of search engines but not in contrast to online piracy. The Ninth Section of the Court of Rome "Yahoo! to inhibit the continuation and repetition of the violation of rights of economic exploitation of the film 'About Elly' by connecting via eponymous search engine sites which reproduce in whole or in part 'work, other than the film's official website.

" The ninth section of the Court therefore obliged to offer Yahoo!, in the results, only results "official", inhibiting the continuation and repetition of the violation of rights of economic exploitation on the film by connecting About Elly by eponymous search engine sites in reproducing all or part of the work, other than the film's official website, "we read in the sentence.

The court has recognized that search engines can not exercise" preventive control over the content of sites to which source is made the link. "Nevertheless, he decided to do so because of copyright infringement Yahoo! knew but did not remove links to pirated anyway. For this reason, the court has recognized the responsibility.

The PFA film production company, which distributes the film in Italy, had in fact sent a warning Yahoo! unsuccessfully seeking to clean up the research results of "sites in reproducing all or part of the work other than official site film, "continues the sentence. E 'then intervened Italy Open Gate, a company that follows disputes over copyright, advancing the cause on behalf of PFA.

Open Gate to the court noted that, by searching with the words "About Elly" on Yahoo, the film's official website was not even among the top positions, pushed aside by links to pages that allow you to download the movie.
