The Senate rejected the appointment of a government commissioner to Arcep

The Senate refused Thursday night to Friday the appointment of a government commissioner in the French gendarme telecoms (Arcep), a prospect that arouses strong criticism, particularly from Brussels. Several amendments to delete this provision from the left and center but also a UMP senator, were adopted by 184 votes against 152 against the advice of the government.

"This appointment is contrary to European law and poses a problem conflicts of interests, "said Hervé Maurey (Centrist Union) who championed an amendment to delete the group. "The group is united in this striking," added Catherine Morin-Dessailly (UC). The appointment of a state representative in the Regulatory Authority for Electronic Communications and Posts (ARCEP) was introduced by the government in a bill implementing several directives, including the "telecoms package" at its first reading by the National Assembly on January 13.

CRITICS OF THE OPPOSITION AND THE EUROPEAN UNION The decision has ignited the powder, first at the National Assembly where the left has accused the minister of industry and the digital economy, Eric Besson, of wanting to "punish" the regulator for granted last year a fourth mobile license to Free.

The president of Arcep, Jean-Ludovic Silicani was mounted to the plate on January 12, asking Mr. Besson "to remember the line beyond which cooperation (with government) may become confused." The European Commission got involved, worrying potential conflicts of interest while the French state holds about 27% stake in the incumbent operator France Telecom.

She has threatened France with an infringement procedure EU law if the project was adopted. Paris has raised an objection of inadmissibility in a letter to its vice president Neelie Kroes. "The objective is to contribute to strengthening dialogue between the government and Arcep, respecting their prerogatives," writes Mr.

Besson. A COMPROMISE REJECTED BY THE GOVERNMENT The Committee on Economics Senate during his screening of legislation, offered a compromise by restricting considerably the powers of the commissioner to make "euro-compatible" and "avoid confusion regrettable "while addressing the government's request to" present his views to Arcep.

But the government did not give in and he had filed an amendment to restore full powers to the Commissioner. However, his amendment has lapsed after the vote on the removal of the section creating the government commissioner in Arcep. "I ask the government to make a gesture by withdrawing his amendment, because in radicalizing his position, he banned any compromise" had told the reporter before the debate the text Retailleau Bruno (not included).

The case is not over. The project is included in an emergency, there is a reading assembly and a joint committee (seven senators, seven members) will try to find a compromise between both chambers, their text will be submitted to a final vote.
